ORDINANCE NO.    2006-03 

AN ORDINANCE AMENDING THE FARLEY CODE OF ORDINANCES, TITLE III COMMUNITY PROTECTION, CHAPTER ONE, OFFENSES, BY ADDING A NEW PARAGRAPH PROVIDING FOR RESTRICTIONS ON PLACING DEBRIS ONTO THE STREET

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FARLEY, IOWA:

            SECTION 1.               That the Code of Ordinances, Title III, Chapter One, Offenses, Section 3-1-4, shall be amended by adding a new paragraph six, reading as follows:

            6.         It is unlawful for any person to throw or deposit on any street or alley any glass, glass bottle, nails, tacks, wire, cans, trash, garbage, rubbish, litter, offal, leaves, grass or any other debris likely to be washed into the storm sewer and clog the storm sewer, or any substance likely to injure any person, animal or vehicle.

            SECTION 4.               WHEN EFFECTIVE.   This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.

            The requirement of Council consideration and vote for passage of this ordinance at two Council meetings prior to the meeting of passage (Section 380.3 of the Code of Iowa) was suspended by recorded vote of at least three-fourths of Council members this             9th       day of              January                       ,  2006.
