Farley City Council met Monday, November 19, 2007, 7:00PM at City Hall.  Mayor Einwalter presiding.  All present. 

 

Agenda approved upon motion.

 

Mayor Einwalter opened the public hearing on Dubuque County/Farley Biodiesel Urban Renewal Area Plan Amendment.  There were no written or oral comments received and the hearing was closed.

 

Motion Jarding, second Kramer to approve Resolution 99-07 approving Dubuque County/Farley Biodiesel Urban Renewal Area Plan Amendment.  Five ayes.

 

Mayor Einwalter opened the public hearing on the Development Agreement with South Lake Development Corp and the authorization of Tax Increment Payments not to exceed $80,000.  There were no written or oral comments received and the hearing was closed.

 

Motion Kramer, second Petsche to approve Resolution 100-07 approving the Development Agreement with South Lake Corp authorizing Tax Increment Payments not exceeding $80,000.  Kramer, Petsche, Scherrman, Jarding aye.  Hefel nay.  Motioned carried.

 

Motion Kramer, second Scherrman to table Western Dubuque Biodiesel billing to next meeting as there was no one present from biodiesel.  Five ayes.

 

Motion Kramer, second Jarding to continue with the Seventh Avenue Project based on new information of lots.  Kramer, Jarding, Petsche, Scherrman aye.  Hefel nay.  Motioned carried.

 

Motion Petsche, second Kramer to assess Seventh Avenue Drainage project as per linear foot not exceeding 25% of the project.  Five ayes.

 

Motion Jarding, second Scherrman approving the Income Survey for Wastewater Treatment Facility Assistance Program.  Five ayes.

 

Motion Kramer, second Hefel approving the second reading of Ordinance 2007-04.  An Ordinance amending the Code of Ordinances by adding a new Section 1-3-3 Administrative Penalties for Municipal Infractions.  Kramer, Hefel, Petsche, Scherrman aye.  Jarding nay.  Motioned carried.

 

Motion Kramer, second Petsche approving offering temporary Officer Douglas Springer the position of part time Officer/Road Patrol.  Five ayes.

 

Motion Scherrman, second Kramer to approve Resolution 101-07 approving Dubuque Metropolitan Area Solid Waste Agency Recycle Station Partners Agreement.  Five ayes.

 

Motion Hefel, second Jarding to approve the consent agenda with pulling the clerk’s report.  Five ayes. Approved were October Treasure’s Report and minutes of 11/05/07 and 11/08/07.  Jarding questioned item on clerks report. 

 

Motion Jarding, second Hefel accepting clerk’s report of October.  Five ayes.

 

Jarding questioned First Avenue pavement markings.  Item to be on next agenda.

 

Chief Wagner relayed to council that the city is being charged more than expected regarding the agreement with the Humane Society.
