Farley City Council met Monday, November 5, 2007, 7:00PM at City Hall. Mayor Einwalter presiding. All present.
Agenda approved upon motion with addition of claims.
Greg Gunderson of MSA Professional Services was present regarding the Water Tower/Well Project. He stated that the contractors are finished except for a few warranty items that will be completed shortly.
Motion Kramer, second Hefel to approve Resolution 96-07 approving Pay Application No. 7 to Jim Schroeder Construction – Contract D in the amount of $24,689.73. Five ayes.
Motion Hefel, second Petsche to approve Resolution 97-07 approving Certification of Final Completion to Jim Schroeder Construction – Contract D for Water Tower/Well Project. Five ayes.
Motion Petsche, second Jarding to approve Resolution 98-07 approving Certification of Final Completion of Water Tower Well Project. Five ayes.
Mayor Einwalter opened three sealed bids received for public works vehicle.
Motion Jarding, second Scherrman to accept bid of $500.00 for public works vehicle. Five ayes.
Council discussed Seventh Avenue water drainage.
Motion Hefel to start assessment process and figure the project into the next budget year. Motion died for lack of a second.
Motion Petsche to start assessment process immediately, have construction start in the spring and make payment to contractor in next fiscal year. Motion died for lack of a second.
Motion Hefel, second Petsche to begin Seventh Avenue drainage assessment procedures and to plan for spring construction based on available funds, making payment(s) in the next fiscal year if funds not available this fiscal year. Hefel, Petsche, Jarding, Scherrman aye. Kramer nay. Motion carried. Item to be on next agenda.
Council reviewed an invoice received from a property owner regarding locating a water leak on Fourth Avenue. The leak was found to be in the basement of property owner.
Motion Kramer, second Hefel that the property owner be responsible for the invoice. Five ayes.
Motion Jarding, second Petsche approving internet service for Well House and Waste Water Treatment Facility. Five ayes.
Police Report received and filed.
Council reviewed Ordinance relating to Administrative Penalties for Municipal Infractions.
Motion Kramer, second Hefel approving the first reading of Ordinance 2007-04, an Ordinance amending the Code of Ordinances by adding a new section 1-3-3 Administrative Penalty – Notice of Violation. Kramer, Hefel, Scherrman, Petsche aye. Jarding nay. Motioned carried. First reading approved. Item to be on next agenda.
Mayor read second reading of Ordinance on No Parking for a portion of First Avenue NE. Discussion followed.
Motion Petsche, second Hefel to approve second reading. Petsche, Hefel aye. Jarding, Scherrman, Kramer nay. Second reading failed.
Motion Jarding, second Scherrman setting the date for a public hearing on South Lake Development Corp Development Agreement and Tax Increment Payments as November 19, 2007, 7:00PM. Five ayes.
Kramer relayed to council members IMWCA recommended firemen physicals will be conducted at Tri State Occupational Health in the amount of $157.00 each for a total of $5,652.00.
Motion Jarding, second Scherrman to pay for physicals with set aside funds. Five ayes.
Motion Jarding, second Hefel to approve consent agenda. Approved were minutes of 10/15/07 and bills as presented. Five ayes.
Kramer updated council on the fire station addition.
Mayor Einwalter reminded council of the Veteran’s Memorial Dedication Ceremony to take place on Veteran’s Day and to place their vote on Election Day.
