Farley City Council met Monday, October 15, 2007, 7:00PM at City Hall. Mayor Einwalter presiding. Scherrman, Petsche, Kramer, Hefel present. Jarding Absent.
Agenda approved upon motion with the changing of Municipal Infraction fees to Administrative Penalty fees.
Greg Gunderson of MSA Professional Services was present and stated that the contractor is finishing up some final punch list items on the Water Tower Well project and should be complete by next meeting.
Tom Brooks of Western Dubuque Biodiesel was present to discuss TDS levels omitted from the plant into the cities wastewater system. Brooks stated that out of the two and a half months of testing the levels, four out of five tests conducted were below an 800 level. He stated that he spoke with the DNR and was informed that there were no TDS limits required. He said that on warm days the sample limits were harder to maintain. He figured over 60% of the sewer charges on the utility bill they should not be liable for as this percentage of water evaporates and does not go into the cities system. He relayed that the plant has incurred costs of $20,000 for a sampling station and costs of chemicals associated with trying to maintain low levels of TDS. He stated that biodiesel has a NDPS Permit with no limit on TDS levels and hauls out seven tanker loads of wastewater per week.
Mayor Einwalter commented that the city went with engineering advice received regarding the TDS level limits and that there is a meeting scheduled with Mike Wade of the DNR and the city for Tuesday, October 16, 2007 at 9:30AM to discuss same.
Dave Kluesner brought a proposal from Tschiggfrie Excavating for 7th Avenue drainage. He stated that he thought this project could be done by Thanksgiving. The total of the proposal was over the 40,000 threshold meaning the city would under law have to go out for bid.
Hefel inquired how to pay for the project.
Petsche stated that 25% of the project costs should be assessed to the property owners.
Hefel stated that the project should be budgeted for.
Motion Hefel that the 7th Avenue Project wait and be budgeted for. Motion died for lack of a second.
Council discussed how to make the proposal under the 40,000 threshold resulting in a motion by Petsche to open up tile line at 506 7th Ave this fall, postpone the storm sewer work until spring and do assessments in the spring. Motion died for lack of a second.
Motion Kramer, second Scherrman to run pipe along the north side starting at 401 7th Ave to 602 7th Ave and to do the cross over pipe next year. Kramer, Scherrman aye, Hefel, Petsche nay. Motion failed.

Motion Kramer, second Hefel to approve Resolution 93-07 approving setting the date of the Urban Renewal Plan Amendment public hearing for Dubuque County/Farley Biodiesel on November 19th, 2007 at 7:00PM. Four ayes.
Motion Petsche, second Scherrman to approve first reading of Ordinance prohibiting no parking for a portion of 1st Avenue NE. Petsche, Scherrman, Hefel aye. Kramer nay. Motioned carried.
Clerk informed council that it is attorney advice that a new development agreement be put into place for South Lake Corporation for the portion of Urban Renewal Area No. 3 that has not been developed but is included in a 2000 development agreement with the city. Item to be on future agenda.
Kramer stated that he is looking into receiving physical forms for the firemen from Tom Berger. Item to be on next agenda.
Motion Kramer, second Petsche to approve Resolution 94-07 approving Financial Report of FYE 2007. Four ayes.
Motion Scherrman, second Kramer to approve consent agenda. Approved were minutes of 10/01/07, September clerks and treasures reports showing receipt by fund as follows: General $32799.25, Road Use 9878.84, TIF 20900.42, Tower/Well Project 141702.98, Debt Service 13249.38, Special Assess 5349.00, Water & Trust 12471.51, Sewer 20914.43 and Resolution 95-07 final TIF Rebate payment of $30948.00 to Simmons Promotions. Four ayes.
Hefel reported that the new ball lights at the park are on.
Kramer stated that the footings have been poured for the fire station addition.
Mayor Einwalter told council that there is a dedication service for the new veteran’s memorial scheduled to take place on Veterans Day, 11/11/07 and that a section of the street will be closed off for the ceremony.
Mayor Einwalter relayed to council that he will be writing a Thank You letter to Tom Thompson and his son for their volunteer work, time and materials for painting the light poles.
Hefel inquired about the manhole in front of Casey’s and asked Public Works Director Link to look into.
